Some answers are as follows:
But what has spawned this site, what ill befell the writer such that over 300 pages of information now appear on this unique internet presence dedicated to a 400+ strong island constabulary? The short answer is that the author's human rights were breached; the police constabulary and government of Bermuda acted other than in accordance with the police disciplinary code. The Bermuda police service's approach to the author was a clear-cut disregard for the rights of an individual. But do not think they will admit this, their investigation failed to find grounds to support the allegation. The evidence is so clear that the reader may have similar trouble understanding the Bermuda Police: Police officers are grown-ups, living in the real world, experiencing the worst side of humanity on a regular basis. The civilised world is regulated and where there are disputes or grievances, these can be resolved formally. It matters not that the problem is one involving crime (dealt with at a Criminal Court), a monetary issue (decided at a Civil Court), a breach of a serviceman's discipline code (heard by an army tribunal - as an example) or in the author's case, an employment / disciplinary issue. In every case there are some fundamental principles of which the following are important in this context: there is a hearing Naturally, the Bermuda police service has a disciplinary code; these are a list of do's and don'ts and they also lay down the manner in which issues are resolved; disciplinary hearings (internal trials). In a civilised society everyone has a right to a fair trial. The author did not terminate his employment with the Bermuda police willingly. The author was paraded before the then Commissioner of police and advised that his contract would not be recommended for renewal; when his contract expired in a few months, it would not be extended, his service was over. The reasons given: a. the officer attempted to tape record a senior officer No evidence of either was ever produced, but then Bermuda did not need to provide corroboration; they do not operate a fair and just system - this is plain the bullying and oppression or a dictatorship. The constabulary circumvented a hearing by ensuring the author was not employed. No chance to defend himself against these petty, trumped-up charges. An even more straightforward argument: The Bermuda police are in breach of their own disciplinary regulations Force Standing Instructions (FSI) state, in brief, any adverse report must be:
The Bermuda police force could not support or justify their action so they did not permit the author access to a disciplinary hearing and provide a means by which the evidence could be aired and cross-examined. They silenced the author by unemploying him and ensuring he was 3500 miles away. There are a number of issues:
Force Standing Instructions; the police code of conduct which detail the constabulary's regulations and procedures apply only to the lower ranks. This should not be the case but it is; there is one law for junior officers another for the senior officers. In the case of seniors officers, possessing the rank of inspector or above is as good as having immunity. An example of one law for senior ranks another for lower; just read what happened to the distasteful Larry Smith and consider it in relation to the author's complaint by clicking here. This site will continue to expose the manner in which this archaic, draconian police force conducts itself. You are warned. Do not expect reasonable behaviour from Bermuda's officials; the constabulary is run by oppression and 'fair' is not in their vocabulary. It suits the Bermuda Police, Bermuda Government and Foreign Office to ignore this complaint. Is the above justified? Well, www.bermudapolice.com has been in existence for many years and no has has taken issue with the content. Why? Because the content is factual, it is not in the author's interest to falsely report matters and undermine the genuine nature of the complaint. One only need consider the words of a Bermudian, Mr E.C. Gibbons a serving senior police officer on the island who wrote to the author in 1996 saying:
Subversion and betrayal, not the author's words; does the above not suggest impropriety on the part of the Bermuda authorities?
